Please read these terms and conditions carefully before ordering any Products from our site.

By clicking on the button marked “[I Accept]” from the order page, you accept these terms and conditions. Please understand that, if you refuse to accept these terms and conditions, you will not be able to order any Products from our site.

1. General

1.1 These conditions shall apply to all contracts for the sale of goods by the Seller to the Client to the exclusion of all other Terms and Conditions including any Terms and Conditions which the Client may purport to apply under any purchase order, confirmation of order or similar document
1.2 Any variation to these Conditions (including any special Terms and Conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

2. Information about the Seller

3. Order Status

3.1 The Seller may provide links on his site to the websites of other companies (whether affiliated with the Seller or not).

3.2 The Seller cannot give any undertakings or warranties (legal promises) that websites of other companies are appropriate or accurate and the Seller shall not have any responsibility for their activities. Therefore, any warranties relating to these companies are disclaimed by the Seller absolutely.

4. Force Majeure

4.1 The Seller will not be liable or responsible for any failure to perform or delay in performance of any Seller’s obligations that is caused by events outside the Seller’s reasonable control (Force Majeure Event). This includes any act, event, non-happening, omission or accident beyond the Seller’s reasonable control. For example (without limitation):

(a) strikes;
(b) riots, terrorist attacks or war;
(c) fire, storm, flood, earthquake or other natural disasters; and
(d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

4.2 The Seller’s performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues and the Seller will have an extension of time for performance for the duration of that period. The Seller will do his best to bring the Force Majeure Event to a close or to find a solution by which the Seller’s obligations under the contract may be performed despite the Force Majeure Event.

5. Data protection

By agreeing to these terms and conditions, the Client also consents to the Seller’s processing of the personal data (e.g. the Client’s name and address) that the Client provides to the Seller in accordance with the privacy policy.

6. The Client’s status

By placing an order through the site alexevecouture.com, the Client legally promises to the Seller that:

(a) the Client is legally capable of entering into binding contracts;
(b) the Client is at least 18 years old; and
(c) the Client is resident in (and the delivery address for the Products is in).

7. Placing an Order

7.1 The Client’s order constitutes an offer to the Seller to buy a Product. All orders are subject to acceptance by the Seller. Such acceptance will be confirmed to the Client by sending him an e-mail that confirms his order for a Product (Order Confirmation). The contract between the Client and the Seller will only be formed when the Seller sends the Order Confirmation to the Client.

7.2 An order will be accepted and work scheduled upon receipt of the 60% (non-refundable) deposit and the signed quotation accepting these Terms and Conditions. Note that no work will commence until the deposit is received by way of cleared funds.
7.3 The Product will be sent to the Client just after the receipt by the Seller of the full price (including delivery charges).

7.4 Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate.

7.5 All delivery dates and lead times are only estimates and subject to change from time to time. The Seller accepts no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery.

7.6 All orders for the Products in stock are processed Monday to Friday, excluding holidays. More detailed information will be provided during the purchasing process.

This information does not apply in the case of pre-orders or make-to-order items, for which the Client will find information on delivery lead time in the respective product datasheets.

8. Consumer Rights 

8.1 All of the Products are made to the Client’s specifications (i.e. are custom-made or bespoke). This means that, unlike most consumer contracts, the Client will not have any right to cancel a contract.

8.2 This term does not affect the Client’s other legal rights.

9. Price and Payment 

9.1 All prices quoted on this website are accurate at the time of publication are quoted in Euro.

9.2 Product prices include VAT (where applicable).

9.3 The Client will be responsible for the payment of any customs or import duties levied once the package reaches his destination country. 

9.4 Product prices and delivery charges are liable to change at any time but changes will not affect orders already placed.

9.5 Payment for all Products must be by credit/debit card (MasterCard, Visa, American Express, Visa Debit, JVC, Diners Club, Maestro) via Stripe or bank transfer.

9.6 If payment:

(a) has not cleared 7 working days after the Client made (or attempted to make) payment for a Product (referred to in the Order Confirmation); or
(b) at any time is recalled or revoked, the Seller shall be entitled to terminate the сontract.

10. Product faults, damage, shortages and order anomalies. Before the Client commits to purchase.

Please note that it is the Client’s responsibility to check the Order is to the exact specification desired prior to payment. In addition, the Client will be sent an email detailing the Order with which the Client has 24 hours to notify the Seller of anything which is not as expected. Specifically, the colours finish and dimensions should be carefully inspected.

11. Availability and Delivery 

11.1 The Seller promises to deliver orders to the Client as soon as reasonably possible, provided that the Client is available to receive a delivery.

11.2 The Seller will send the Client carrier details with a tracking code.

11.3 Delivery Times and Charges

Stock deliveries to Il-de-France region (France) addresses are free of charge and the Seller endeavours to make them within 3-5 business days (Monday to Friday).

Other national and international deliveries are charged by volumetric weight and are calculated at the checkout.

The Seller delivers to most national and international destinations. Deliveries to all international (non-EU) addresses will take longer, but the Seller tries to send all orders by the quickest route possible.

11.4 Delivery Lead Times

In-stock items are available within 5-16 business days depending on the Client’s destination. Made-to-order and custom pieces remain at a standard lead time (from ordering the goods to delivery) of 8-14 weeks.

*Please note, all delivery times are estimates, larger rug sizes, in particular, can take longer than the quoted time to produce. The Seller will be in touch post order to confirm delivery times.

Time of delivery is not of the essence in this Agreement. The Seller will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of alexevecouture.com or delay due to any reasonable rescheduling of delivery.

12. Risk and Ownership 

12.1 Goods delivered shall be at the Client’s risk from the time they are delivered.

12.2 The Client will only own the Products once he has paid the Seller in full (including for any delivery charges) – until the Seller has received full payment, the Products will belong to the Seller. If (for any reason) payment for the Products is recalled or revoked, ownership shall immediately revert to the Seller.

13. On Delivery of Goods

Please note that it is the Client’s responsibility to check the goods for any faults, damage or shortages and record any problems on the delivery receipt. If the item is badly damaged, refuse it and contact the Seller immediately via e-mail [email protected] or WhatsApp (SMS) +33.6.48.75.43.28

14. Acceptance of the Goods

14.1 The Client shall be deemed to have accepted the goods just after delivery to the Client.

14.2 After acceptance, the Client shall not be entitled to reject Goods that are not in accordance with the contract.

14.3 Where the Client accepts or has been deemed to have accepted any goods, then the Seller shall have no liabilities whatever to the Client in respect of those goods.

15. Returns and Refunds

No returns and refunds are possible.

Please note that, as all Products are custom-made or bespoke, the Seller cannot offer refunds simply because the Client has changed his mind.

16. Product Description

The Seller takes every care to ensure that the description and specification of his products are precise. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, the Seller cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products.

17. Product Size and Colour

All of the Seller’s products are handmade, and rugs can vary in size by up to 15 cm in width, length or diameter from the size shown. Also, colours can vary slightly from rug to rug. 18. Applicable Law

We own, control and operate the website from our office within France. Accordingly, the laws of France govern claims relating to, including the use of the website and the materials contained therein. If you choose to access our website from outside France you do so on your own initiative and you hereby agree that in the event of a dispute between Alexevecouture.com and you the laws of France will apply at all times.
